1. INFORMATION ABOUT THE GOODS 
We will do our best to ensure that the information regarding the Goods is accurate and up-to-date. However, we do not guarantee that there are no errors in the description and / or prices of the Goods, or that the Goods are always available if you wish to place an Order in order to purchase them. None of the items contained on our Site should be considered as an affirmation or statement regarding the Goods. All images, illustrations and descriptions of the Goods are for informational purposes only and you are welcome to contact us using the contact details in the Contact Us section. if you need any further information about the Goods. 

We reserve the right, at any time and without notice, to change the information about the Goods displayed on our Site, including, without limitation, price information, description and availability of the Goods. However, price variations, availability or description of the Goods will not affect Orders that you have placed and that we have already accepted in accordance with Article 2 below. 

The foregoing will not affect your rights. 

2. HOW TO ORDER
To place an Order, you must be at least 18 years old. You must choose the Goods on the Site, select your preferred shipping method and, at your option, other optional services and then click on the “CONTINUE”button. Before finalizing the payment procedure for your purchase, you will be asked to either create your personal account or to connect to it. You can, if you prefer, settle your purchase without registering. But you will need to provide your necessary personal data and your data on the method of payment chosen to continue the Order. We will not accept Orders placed by any method other than the one detailed above. If you encounter any problems during the placing of an Order, or if you are not sure whether your Order placed through the site has been finalized or not, contact us at the coordinates indicated in the section Contact us . When you place an Order, you make us an offer to purchase the Goods you have chosen. Orders are subject to the availability of goods and subject to our acceptance. We may, at any time and in our sole discretion, refuse to accept your Order, including but not limited to: (i) You have provided us with incorrect information, including insufficient or incorrect bank details, information about incorrect billing an insufficient or incorrect shipping address; or fraudulent information; (ii) There is an error on our Site in connection with the Goods you have ordered, for example an error related to the price or description of the Goods as displayed on our Site; (iii) The Goods you have ordered are no longer available through our Site; or (iv) We think you are not 18 years old. We are not responsible to you or any third party for the withdrawal of Goods from the Site, the deletion or revision of any information or content on the Site, the refusal to process an Order or the suspension of any transaction after we started running it. If we are unable to accept your Order, we will contact you as soon as possible by email or telephone, and no later than 3 ( three ) days from the date of your Order. If we can not accept or fulfill your Order due to unavailability of the Goods, or due to an error in pricing and / or other information about the Goods for which you placed an Order, we will contact you and we will offer other products as a replacement that you may wish to purchase. If you do not accept our proposals, we will cancel your Order for Goods that we are unable to provide and we will refund you for the amounts you have paid to us for those Goods. If you placed an Order through the Site, you will receive an email acknowledging receipt of your Order, containing the relevant details of your Order (for example, quantities, prices and shipping terms). Please note that this email does NOT constitute an acceptance of your Order. Unless you cancel your Order, it will be accepted and the contract between us and you will not be concluded until we have shipped the Goods. Therefore, you will receive an Order Confirmation email informing you that we have shipped all or part of the Goods that are the subject of your Order. Orders may be canceled at any time before we process them. If you wish to cancel your Order, please contact us using the contact details listed in the Contact Us section. We will not accept order cancellations made by any method other than the one detailed above. Once your Order has been processed, you may exercise your right of withdrawal only in accordance with the procedure stipulated in Article 8 below. 3. APPLICABLE PROCEDURE FOR UNAVAILABLE GOODS We will do our best to ensure that the information displayed on our Site about the Goods is always accurate. However, when placing an Order, some Goods may be out of stock. If we are unable to send you the ordered Goods within 3 ( three days from the date of your Order we will cancel your entire 

Order and we will refund the cost of the Goods. Nothing in these terms and conditions of sale affects your legal rights to defective or incorrectly described goods.
4. OUR PRICE POLICY 
The prices of the Goods are indicated on our Site and will be confirmed in the Order Confirmation that we will send to you by email. 

All prices are denominated in US dollars.
 
Delivery charges may apply to your Order as indicated on our Site at the time you submit your Order. Delivery costs depend on the value of your Order and the method of shipping you require.  

We reserve the right to change the price of our Goods on our Site at any time without notice. Changes to the price of the Goods will not affect your Order once we have accepted it and we have sent you an Order Confirmation. 

If we find an error in the price of the Goods you have ordered, we will notify you as soon as possible by email or telephone and we will give you the choice to reconfirm your Order at the correct price or cancel it. If you cancel the Order, we will refund the amount paid by you or we will defer it to your credit. 

5. TERMS OF PAYMENT 
you can pay your Goods by check, cash, transfer, Paypal. Payment must be made in the currency indicated on your Order before submitting it. 

If you pay via PayPal, you will be asked to log in to your account, using your email address and password for your payment to be confirmed. If you do not have a PayPal account, you will still be able to pay via PayPal for a number of transactions limited to a maximum of 10, and you will need to enter your personal data and credit card details. Your Goods will be provided upon approval of your payment. If we do not receive payment based on funds available within 30 days from the date of your Order, we will cancel your Order. 

We will send the Goods to the delivery address indicated on your Order Confirmation. However, we may send you the related documents by email only to the email address you provided at the time of placing the Order. 

6. DATE AND TIME OF DELIVERY OF GOODS AND TERMS OF TRACKING OF MY ORDER 


Delivery can be made by standard or express courier service at your convenience during normal business hours. Delivery charges may apply to your Order; upon delivery of the Goods to our carrier, we will send you an Order Confirmation email. 

We will make all reasonable efforts to deliver the Goods within the delivery time specified in our General Terms of Delivery. However, any date or time of delivery that we specify is only given as our best estimate and we will not be liable for any loss or damage you may suffer due to unavoidable delivery delay. 

If, at the delivery address indicated, there is no one who can accept the delivery of the Goods, the carrier will leave you a notice in your mailbox. 

The transfer of ownership and risks associated with your Goods to you occurs on the day of delivery.

7. HOW TO RETURN GOODS 
We hope you are satisfied with your purchases, however we understand that you may wish to return all or part of the items. Goods that have been supplied in error, that have been found to be incomplete, damaged or defective may be returned to us using the procedure on our Returns page.
 
8. TERMS AND CONDITIONS FOR PROCESSING YOUR PERSONAL DATA 
By placing your Order, you agree and understand that we may store, process and use data collected when you registered on the Site to process your Order.
11. USE OF THE SITE 
Use of this Site is subject to the Terms of Use available at Privacy Policy. 

12. INTELLECTUAL PROPERTY RIGHTS 
other trademarks, illustrations, images and any logo appearing on our products, accessories or packaging, whether registered or not, are and remain the exclusive property of KENMORE SOLUTIONS. Any reproduction, whether complete or partial, any modification or use of these marks, illustrations, images and the logo, for any reason and in any means of communication whatsoever, without our prior consent , express and writing, is strictly prohibited and will lead to prosecution. 

13. EXTERNAL CAUSES 
We will do our utmost to fulfill our obligations under these Terms of Sale. However, we cannot be responsible for any delay or non-performance, if such delay or non-performance results from a force majeure beyond our reasonable control, including, without limitation, a natural disaster, an explosion, flood, fire or accident; war or public unrest; strike, social movement or work stoppage; any form of government intervention; an act or omission of a third party; a failure of our supplier (s); a failure on your part to give us a correct delivery address or notify us of any change of address, or a failure on your part that may affect the payment. 

We will inform you as soon as possible of such an unforeseeable event after its occurrence, and we will fulfill our obligations as soon as possible.

14. APPLICABLE LAW 
These Conditions of Sale are governed by Dominican Republic laws excluding the United Nations Convention on Contracts for the International Sale of Goods. 

15. RESALE / REEXPEDITION OF OUR MERCHANDISE 
We constantly monitor the quality of the Goods we offer to our customers in order to guarantee a constant satisfaction of our customers. Our Goods are only distributed in our stores and in the stores of our authorized resellers. You are not authorized to misrepresent yourself as one of our authorized resellers or to falsely represent you as qualified to resell our Goods. We reserve the right to refuse to accept your Order if we suspect that you intend to resell our Goods.

17. GENERAL CONDITIONS 
The fact that we do not require and the fact that you do not require the application of any clause of these Conditions of Sale shall in no case be considered as a waiver to invoke these clauses. This non-execution can not in any case later affect the right to enforce the said clause. 

18. DEFINITIONS 
In these Conditions of Sale: 

”Contract" means the contract between you and us for the sale and purchase of Goods, which includes your Order, Confirmation of your Order and these Conditions of Sale; . " Goods" means products that we periodically sell on our Site, including, but not limited to, specialty and technical clothing, outerwear, shoes, bags, sleeping bags, rucksacks, backpacks for day, tents and accessories for camping, hiking, mountaineering and other outdoor activities; computer equipment, electronics etc . ”Order” means an order for Goods placed under these Conditions of Sale;  "Confirmation Order " means the order confirmation you receive from us and indicating acceptance of your Order at the time the goods are shipped and relevant details of the goods you have purchased; . " Conditions of Sale”means these general conditions of sale;”We", " our" refers to Kenmore Solutions ., Whose head office is located at
